Terms of Service

These Terms govern your use of the Riptide Roof Diagnose web application (the "Service"), operated by Riptide AI Consulting LLC ("Riptide"). By using the Service you agree to these Terms.

1. The Service

The Service uses artificial intelligence to analyze photographs of roofs and surface possible damage. The output is informational only and is not a substitute for a professional on-site inspection by a HAAG-certified or otherwise qualified roofing inspector. Do not file insurance claims, schedule repairs, or make material business decisions based solely on the Service's output.

2. Subscription billing

The Service is offered as a paid monthly or annual subscription. By subscribing, you agree to the following terms.

Auto-renewal

Monthly subscriptions renew on the same day each month; annual subscriptions renew on the same day each year. Renewal is automatic — your card on file is charged at the start of each new billing period until you cancel. By subscribing, you authorize this recurring charge.

Monthly photo cap

Each paid tier includes a monthly photo-analysis cap (1,000 for Starter, 5,000 for Crew, 8,000 for Pro, 13,500 for Team; Enterprise is contract-based). The cap resets at the start of each calendar month (UTC). When you reach the cap, the Service prompts you to upgrade to the next tier. Your data, reports, and history remain accessible — only new analyses are blocked until you upgrade or until the cap resets.

Upgrades and downgrades

You may upgrade your tier at any time via the customer portal (accessible from the License Badge inside the Service). Upgrades take effect immediately and our payment processor (Stripe) prorates the difference for the remainder of the current billing period. Downgrades take effect at the start of the next billing period.

Cancellation

You may cancel at any time via the customer portal. Cancellation is effective at the end of the current billing period — you retain Service access until then. There is no early-termination fee. We do not provide partial-month refunds for unused time in a billing period.

Failed payments

If a renewal charge fails, Stripe retries automatically for up to 3 days. During this window your Service access continues uninterrupted (a "grace period"). If the retries do not succeed, your access is suspended until you update your payment method via the customer portal. Suspended accounts retain their data per our data retention policy.

Refunds

Except where required by law, all subscription payments are non-refundable. We do not refund partial months or unused capacity. If you believe you have been charged in error, email hello@riptideai.co within 30 days of the charge and we will review.

Price changes

We may change subscription prices. Any price change for an existing subscription will be communicated by email at least 30 days before it takes effect. You may cancel within that 30-day window to avoid the new price.

Free use without subscription

The Service may offer limited free analyses without requiring a credit card. Free usage is rate-limited and is not a substitute for a paid subscription. No subscription is created and no card is charged unless you complete a checkout flow.

Taxes

Prices are exclusive of applicable taxes (e.g., sales tax, VAT). Your invoice will include any taxes Stripe is required to collect based on your billing address.

Disputed charges

Before disputing a charge with your bank or card network, please contact hello@riptideai.co. Most billing questions are resolved within one business day. Initiating a chargeback without first contacting us may result in account termination.

3. No warranty

The Service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied. Riptide makes no warranty that the Service will be accurate, uninterrupted, secure, error-free, or that findings will be complete or correct. AI vision models can hallucinate, miss damage, misidentify features, and produce inaccurate bounding boxes. You assume all risk arising from your use of the Service.

4. Limitation of liability

To the maximum extent permitted by law, Riptide and its officers, directors, employees, and contractors will not be liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, claim denials, repair costs, property damage, or business interruption, arising from your use of the Service. Our aggregate liability for any claim arising out of or relating to these Terms or the Service is limited to the amount you have paid Riptide for the Service in the 12 months preceding the event giving rise to the claim, or USD $50, whichever is greater.

5. Acceptable use

You agree not to:

• Reverse-engineer, scrape, or attempt to extract the underlying AI models or prompts.
• Submit photos that aren't roofs in an attempt to abuse or confuse the system.
• Submit images that infringe on third-party rights, contain illegal content, or include personally identifying information of people in the frame without their consent.
• Use the Service to provide commercial roofing inspection services without disclosing that AI is being used and that findings require professional verification.
• Misrepresent Service output to third parties (e.g. presenting AI findings to an insurance adjuster as if produced by a certified human inspector).
• Exceed reasonable usage limits. We may apply rate limits to protect the Service.

6. Insurance and claims

Insurance claim outcomes depend on professional inspection, documented test-square methodology (for hail), and adjuster review. The Service does not produce insurance-ready documentation and does not certify damage. Always confirm findings with a licensed roofing professional before any claim is filed.

7. Intellectual property

The Service and all components thereof — including without limitation the source code, user interface, design assets, brand marks (including Riptide AI™ andRoof Diagnose™), the HAAG-aligned inspection prompt, the damage taxonomy, the structured-output schema, the state-specific code-citation libraries (FBC for Florida, ORC for Ohio, IRC default), and the test-square methodology guidance (collectively, the "Riptide IP") — are the exclusive property of Riptide AI Consulting LLC and are protected by United States copyright law, trademark law, and trade-secret law (including the Defend Trade Secrets Act of 2016). All rights are reserved. No license, express or implied, is granted to you by these Terms except the limited right to access and use the Service for your internal business purposes during your active subscription or free-trial usage.

You may not, directly or indirectly: (a) copy, reproduce, modify, translate, or create derivative works of any part of the Riptide IP; (b) reverse engineer, decompile, scrape, or otherwise extract the AI prompts, code-citation libraries, or any underlying schemas; (c) use the Service or any output thereof to develop, train, or improve a competing product or service; (d) remove or alter any copyright, trademark, or other proprietary notice; or (e) sublicense, lease, sell, or transfer the Service to any third party.

You retain ownership of any photos you upload. You grant Riptide a non-exclusive, royalty-free license to use those photos solely to operate and improve the Service (e.g. running them through our AI provider, debugging errors). We will not sell, license, or publish your photos to third parties.

8. Termination

We may suspend or terminate access to the Service at any time, with or without notice, if you violate these Terms or if we discontinue the Service. You can stop using the Service at any time.

9. Changes to these Terms

We may update these Terms. Material changes will be notified via prominent notice on the Service. Continued use after a change constitutes acceptance.

10. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict of laws principles. Exclusive venue is the state and federal courts located in Harris County, Texas.
